LIABILITY
I, the
Client, understand and accept that CHARMING HIDEAWAYS LTD:
- offers
vacation rental reservation services for short-term holiday properties in
Paris, France.
- acts as a
booking agent between guests & hosts. The information provided is based on
circumstances normally in existence in the homes at the time of inspection
by CHARMING HIDEAWAYS LTD or its representative in Paris and every attempt
has been made to ensure high standards and that all descriptions and
information are supplied in good faith.
- does not provide
accommodation. My contract is directly with the owner.
- does not accept
responsibility nor shall be held liable for any matters that arise as a
result of events beyond its control. Although extremely unusual, CHARMING
HIDEAWAYS LTD reserves the right to transfer accommodation should it
consider this necessary or offer a full refund of monies and will notify me
of any changes as soon as possible. All inquiries are processed free of
charge.
- shall not be
liable to me or a member of my group for any temporary defect, stoppage in
the supply of public services to the property, nor in respect of any
equipment, plant, machinery or appliance in the property.
I, a member
of my group or a guest invited by me or by a member of my group:
- are responsible
of any degradation on the property and its contents during the rental
period.
- agree to remain
discreet and respect the privacy of the other occupants of the building and
to behave in a civil manner, avoiding loud noise and unruly behaviour which
may disturb other tenants.
- may not request
refund for unsatisfying size, location, external events or environment of
the apartment.
- agree to immediately contact the owner/greeter/manager by phone in the
unlikely event of problems pertaining to electricity, plumbing, theft, fire,
appliances or security so that matters can be fixed efficiently and
quickly.
I agree that once I have received the name and contact information of the
owner/greeter/manager of the apartment through the Rent receipt,
CHARMING HIDEAWAYS LTD shall be deemed to have satisfied its obligations
under this Terms and Conditions agreement. I have accepted and shall
thereafter look solely to the owner of the property to indemnify me against
any damages (including attorney’s fees) relating to the execution of the
rental contract. I agree that all contractual obligations arising out of
this rental shall be deemed to come into existence in Paris, France and be
subject to French law and the exclusive jurisdiction of the Parisian courts
and that disputes are to be settled between myself and the owner of the
property rental.
I understand that
if I cancel the reservation CHARMING HIDEAWAYS LTD will not refund the
reservation fee.
I agree that, upon
arrival, I shall pay the rent in full plus the security deposit indicated on
my Rent receipt directly to the owner/greeter/manager and shall deal
directly with the owner/greeter/manager if any questions arise regarding my
stay in the apartment. I understand that if all monies due are not paid at
this time, the owner/greeter/manager may deny me access to the apartment.
TRIP
CANCELLATIONS AND OTHER INSURANCES
French law requires the client to be covered by comprehensive liability and
travel insurance (health, accidents and liability), while occupying a rental
property. Subscribing to this insurance is the client's personal
responsibility. A copy of this insurance document is requested by the owner
upon arrival.
As insurance regulations and the notion of liability vary between different
countries, the client should inquire with his/her personal insurance advisor
to ensure that he/she and any travel companions are covered in the event of
personal injury or property damage. Under no circumstance shall the owner
and/or CHARMING HIDEAWAYS LTD be held legally responsible for any acts or
outcomes connected with the use and occupancy of the property, including but
not limited to injuries, damages, losses from fire theft and criminal
activity or incidents while traveling to and from the property.
Client
acknowledgement and agreement on the conditions described above:
I, the party leader, am fully aware that all use of the rental property and
its facilities is entirely at our own risk. The owner of the property, as
well as CHARMING HIDEAWAYS LTD, cannot be held responsible for accidents of
any nature occurring within the boundaries of the property and its immediate
surroundings by myself or a member of my group. I declare that me and all
members of my group are covered by a valid insurance policy, abandon the
possibility of any legal action against the owner and CHARMING HIDEAWAYS LTD
for any incident that may occur during our stay, and agree to accept full
responsibility for any such action that we may wish to bring against a third
party.
